Letter from Terry Hammond

Welcome to Terry W. Hammond Consulting. My name is Terry Hammond, and I have worked as an advocate for the elderly and people with disabilities since the needless death of my 83 year old paternal grandfather with dementia in 1991.

I have dedicated my efforts to protecting the rights and the quality of life of the elderly and disabled through my private law practice in Texas as well as by sustained volunteer efforts with the National Guardianship Association, National Guardianship Network, Texas Guardianship Association, and collaboration with a number of other state guardianship associations.

My advocacy has been reported in such venues as the New York Times, The Wall Street Journal, The Dallas Morning News, the Associated Press, and on NBC Dateline. Additionally, I am privileged to have served as President and Executive Director of the National Guardianship Association, as Chair of the National Guardianship Network, and for multiple terms on the Board of Directors for National Guardianship Association and Texas Guardianship Association. In a representative capacity for one or more of these organizations I have been interviewed by USA Today, Money Magazine, and The Los Angeles Times and I have been a guest on National Public Radio’s “Talk of the Nation”. I have testified before the U.S. Senate Special Committee on Aging along with a number of state legislatures and have worked very hard to reform of the Texas Adult Protective Services and guardianship systems.

I have observed that, over the course of my professional career, there has been an increased need for technical expertise in the area of alternatives to guardianship/conservatorship, capacity adjudication, guardianship/conservatorship administration, and compliance by guardians with ethical guardianship/conservatorship decision-making standards and legal standards for guardians.

Family members and professional alike including attorneys often desire and need consultation with or mediation by a knowledgeable outside party to determine or defend a particular course of action. Legal counsel or litigants may need to consult with or to retain an expert witness, or to retain Pro Hac Vice assistance of counsel. I have also conducted Quality Assurance Reviews of guardianship programs and court systems. I particularly enjoy being involved in resolving situations where a person may be under an improperly or ill-advised guardianship or conservatorship proceeding and there is a possibility of partial or full restoration of that person’s rights.
